Section 1: General Terms
YOU ACCEPT AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT BY SUBSCRIBING, VIEWING, OR USING THE SOFTWARE PRODUCT. YOU MUST AGREE TO THE TERMS OF THIS AGREEMENT BEFORE YOU WILL BE ALLOWED TO USE THE SOFTWARE PRODUCT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU MUST CEASE VIEWING ANY PRODUCTS ASSOCIATED WITH THIS PRODUCT AND DISCONTINUE ANY USE OF THE SOFTWARE PRODUCT.
Restrictions on Transfer
Without first obtaining the express written consent of ETAC, you may not assign your rights and obligations under this Agreement, or redistribute, share, encumber, sell, rent, lease, sublicense, or transfer your rights to the Software Product.
Restrictions on Use
You may not decompile, “reverse-engineer,” disassemble, or otherwise attempt to derive the source code for the Software Product.
Restrictions on Alteration
You may not modify the Software Product or create any derivative work of the Software Product or its accompanying documentation. Derivative works include, but are not limited to, translations. You may not alter any files that may be downloaded as a result of accessing the Software Product. This Agreement does not permit the sharing or use of ETAC materials in a classroom setting or otherwise.
Disclaimer of Warranties and Limitation of Liability
UNLESS OTHERWISE EXPLICITLY AGREED TO IN WRITING BY ETAC, ETAC MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANT ABILITY OR FITNESS FOR A PURPOSE OTHER THAN AS SET FORTH IN THIS AGREEMENT.
ETAC makes no warranty that the Software Product will meet your requirements or operate under your specific conditions of use. ETAC makes no warranty that the operation of the Software Product will be secure, error-free, or free from interruption. YOU MUST DETERMINE WHETHER THE SOFTWARE PRODUCT SUFFICIENTLY MEETS YOUR REQUIREMENTS FOR SECURITY AND UNINTERRUPTABILITY. YOU BEAR SOLE RESPONSIBILITY AND ALL LIABILITY FOR ANY LOSS INCURRED DUE TO FAILURE OF THE SOFTWARE PRODUCT TO MEET YOUR REQUIREMENTS. ETAC WILL NOT, UNDER ANY CIRCUMSTANCES, BE RESPONSIBLE OR LIABLE FOR THE LOSS OF DATA ON ANY COMPUTER OR INFORMATION STORAGE DEVICE.
UNDER NO CIRCUMSTANCES SHALL ETAC, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY OTHER PARTY FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND (INCLUDING LOST REVENUES OR PROFITS OR LOSS OF BUSINESS) RESULTING FROM THIS AGREEMENT, OR FROM THE FURNISHING, PERFORMANCE, OR USE OF THE SOFTWARE PRODUCT, WHETHER DUE TO A BREACH OF CONTRACT, BREACH OF WARRANTY, OR THE NEGLIGENCE OF ETAC OR ANY OTHER PARTY, EVEN IF ETAC IS ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT THAT THE APPLICABLE JURISDICTION LIMITS ETAC’S ABILITY TO DISCLAIM ANY IMPLIED WARRANTIES, THIS DISCLAIMER SHALL BE EFFECTIVE TO THE MAXIMUM EXTENT PERMITTED.
Limitation of Remedies and Damages
Your remedy for a breach of this Agreement is the correction or replacement of the Software Product. Selection of whether to correct or replace the Software Product will be at the sole discretion of ETAC. ETAC reserves the right to substitute a functionally equivalent copy of the Software Product as an update or replacement. If ETAC is unable to provide a replacement or substitute Software Product or corrections to the Software Product, your sole alternate remedy shall be the termination of a concurrent subscription.
Governing Law, Jurisdiction, and Costs
This Agreement is governed by the laws of Georgia, without regard to Georgia’s conflict or choice of law provisions.
If any provision of this Agreement shall be held to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect. To the extent any express or implied restrictions are not permitted by applicable laws, these express or implied restrictions shall remain in force and effect to the maximum extent permitted by such applicable laws.
Member Account Security
If any services require you to open an account, you must complete the registration process by providing us with current, complete, and accurate information as prompted by the applicable registration form. You also must choose a password and a user name. You, the end user, are solely responsible for maintaining the confidentiality of your password and account credentials. Furthermore, you are solely responsible for any and all actions or activities that occur under your account, excluding any breaches of your account that occur within ETAC.
By initiating an ETAC member account, you agree to notify ETAC immediately of any unauthorized use of your account or any other breach of security. ETAC will not be liable for any loss that you incur due to the use of your password or account by any third party, either with or without your consent. However, you may be held liable for losses incurred by ETAC that result from third party access to your account or password. You may not use anyone else’s account at any time as all member accounts are intended for use by the single intended registrant.
Section 2: End User License Agreement: Subscription and Streaming Products
Each copy of ETAC training materials (“the Software Product”) and accompanying documentation is licensed and not sold. This Software Product – including, but not limited to, other streaming subscriptions, training bundles, individual course and video downloads, and workbooks – is protected by copyright laws and treaties, as well as laws and treaties related to other forms of intellectual property. ETAC, Inc. or its subsidiaries, affiliates, and suppliers (collectively “ETAC”), located at 565 Research Dr., Athens, GA 30605 USA, own intellectual property rights in the Software Product. The Licensee’s (“you” or “your”) license to download, stream, use, or change the Software Product is subject to these rights and to all the terms and conditions of this End User License Agreement (“Agreement”).
This Agreement entitles you to view and use the Software Product on one active connection at a time on any compatible device. This Agreement does not permit the downloading of content contacted in the Software Product beyond the standard buffer that video players use in the streaming of content. This Agreement does not permit the use of the Software Product on more than one computer or device at any given time, nor may the materials be accessed by more than one user per login credential (see Member Account Security). ETAC requires a 1-to-1 license-to-user ratio for all materials.
By starting your membership, you expressly agree that ETAC is authorized to charge you a membership fee at the current published rate. Your subscription to ETAC will automatically renew at the end of each subscription term unless you cancel your renewal prior to the end of said term. You may cancel your subscription renewal via email, contact email@example.com with at least 10 business days advance notice before your automatic renewal date. If you cancel all access granted to your prodcuts, subscriptions or memberships will be immediately discontinued. Automatic cancellation will occur if recurring payment method is denied or fails to provide payment. Your account will be suspended after multiple attempts and you will be contacted. If we do not receive a response your account will be permanently disabled and a fee will be established depending on your products to re-connect. This fee will be set at 25% of the purchase price plus balance of what was due prior to your account being disabled.
-Discounts, rebates, and other special offers only valid for initial term; subscriptions renew at the then-current full subscription rates.
-ETAC may increase subscription fees for a subsequent subscription period at any time and for any reason, provided that ETAC provides notice at least thirty (30) calendar days prior to the expiration of the subscription.
-ETAC may terminate the subscription and these Terms if it is unable to renew the subscription based on inaccurate or outdated credit card information.
-You may cancel by emailing firstname.lastname@example.org within 10 business days of his or her next billing date to avoid a new monthly charge.
Refunds: All purchases are final and nonrefundable. If a request to cancel membership either Monthly or Annual is initiated no refunds will be granted and all access to ETAC, usveteranjobs.com and any associated partner products including but not limited to INE, NetworkDojo and CloudMyLab access will be terminated.
Disputes: All credit card disputes will be answered with a copy of these terms and conditions as well as the text that is located at the top of the Cart at checkout. By purchasing you have agreed to the no-refund policy outlined within these terms and conditions and by doing so you have waived all rights to dispute based on any reason you may submit to your credit card institution.
All electronic product purchases and pre-orders, including but not limited to lab workbooks, are final, nonrefundable, and nontransferable to any third party unless a prior licensing agreement is documented in writing and approved by ETAC. Electronic accounts suspected of being used by any party other than the purchaser or single intended recipient are subject to revocation without prior notice at the complete and sole discretion of ETAC. Accounts suspended in this manner will not be eligible for refund nor store credit for any used or unused portion of the subscription or materials therein. All electronic products including, but not limited to passwords, dynamic URLs, unique and watermarks, are subject to copy-protection schemes. Any discounts, price modifications, or special deals offered by our sales team associates or website are valid only when purchased directly through usveteranjobs.com by the end user and are not valid through any of ETAC’s affiliates, partners, or resellers.
Section 4: Payments, Pricing and Promotions.
Payment Failures and Non-Payment Policy
If your installment charge ever fails on your credit card for any reason, you will be contacted by our billing department via email. You will have 5 days from that day to respond to the email and correct the declined payment with our billing team (please ensure “email@example.com” is on your email “whitelist”). If, on 5th business day following the failed payment, we have not heard from you nor have arrangements been made to process the payment using another method, your account will go into default and will be suspended from all access to your training materials, including those previously available in your Member Account and not associated with the unpaid order. To reinstate access to your account after it has been suspended, your remaining balance must be paid in full. In addition, you will be required to pay a 25% re-instatement fee to have your account restored.
Any exceptions to the Payment Plan Policy are at the sole discretion of the billing department.
Price Changes and Refunds
Product pricing is subject to change without notice. If there is a price drop within 48 hours of your original purchase, you may request a store credit for the price difference, provided your purchase was made at full price. This offer does not apply to any special deals, promotions or discounts you may have already received. This store credit is nontransferable and expires 180 days from the date of the original purchase. All purchases, including pre-orders, are final and nonrefundable.
Store credits may be issued in a variety of cases. After 180 days, the credit will be void. Store credits may not be transferred nor converted into a cash refund under any circumstance.
Promotional offers may occasionally be available with specified purchases. Promotions cannot be combined with any other discounts, promotions or offers unless otherwise stated. The terms and conditions of any promotional offer are set out in the promotional material for such offer, which may vary from our standard terms and conditions, but remain subject to our End User License Agreement. ETAC reserves the right to discontinue promotions at any time. Please ask our sales team for details if you have questions about any promotion.
Section 5: Content Terms
Cisco Titles – If Cisco announces a blueprint change affecting a product you purchased, you will have free, automatic access to the updated product when it becomes available, provided the announcement is made within six (6) months of your original purchase. Any errata or solutions guide updates made to workbooks will be posted in your Members account for the product you purchased.
ETAC Training Bundles - Customers are entitled to product updates only for courses contained in their original bundle at the time of purchase. Customers are not entitled to receive additional courses which have been added to the bundle after the original purchase date.
All Access Pass - Members always have unlimited access to our entire catalog of 2,200+ streaming online products, including all updates made to these products.
While every effort has been made to ensure that all material in our publications are as complete and accurate as possible, the material is presented on an “as is” basis. Neither the authors nor ETAC, Inc. assume any liability or responsibility to any person or entity with respect to loss or damages incurred from the information contained in workbooks or other content.
All content is developed by ETAC, Inc and/or its partners, unless otherwise stated and is an original work of the author(s). Any similarities between material presented in our content and actual Cisco or other proprietary lab material is completely coincidental.
Third-party Vendor Identity Usage
All logos and brands are property of their respective owners. All company, product, and service names used in this website are for identification purposes only. Use of these names, logos, and brands does not imply endorsement.
Section 6: Binding Terms and Conditions and Privacy Policies of ETAC, Inc. partners.
ETAC, Inc. leverages products within our partner network. All Terms, Conditions, Policies and Privacy Warranties are inclusive to those policies set forth by the partners on their websites and company documentation. By accepting ETAC, Inc.’s Terms and Conditions you are also agreeing to all terms and conditions set forth through the partners with regards to the use of their products that were purchased as part of your membership.
ETAC, Inc. is the end customer of these partners and has ultimate rights over the products purchased for your use. If you cancel, fail to pay or otherwise suspend your membership subscription with ETAC, Inc., this in turn releases all products associated with you with these partners and ETAC will take ownership of said products. You are not guaranteed any access to these products in this situation.
A breach of the partner terms and conditions will in turn cause a breach of these Terms and Conditions.
